1. About this policy

Red Flag Financials (“we”, “us”, “our”) works with clients who provide financial records and other documents for an initial financial assessment. We reconstruct and analyse the available financial information to identify transactions, inconsistencies, unexplained movements and patterns that may warrant further investigation. We respect your privacy and handle personal information carefully.

This policy explains what personal information we collect through our website (redflagfinancials.com.au), why we collect it, how we use and store it, when disclosure may occur, and how you can access, correct or complain about our handling of it.

We handle personal information in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

2. What we collect

Information you give us through our enquiry and contact forms:

• Your name

• Your email address

• Your phone number (optional)

• Whether you are currently represented by a solicitor

• A description of your situation, in your own words

• The concerns you tell us about (for example, hidden assets, unexplained transactions, or concerns about financial control)

• How you heard about us (on our general contact form)

Information you share with us through Dropbox or Google Drive links or folder invitations includes financial records and other documents.

Information you give us through website chat:

• Our website includes a chat feature provided by Wix. If you use it, we collect the messages you send and any name or contact details you provide in the chat.

Information collected automatically:

• Our website is hosted on the Wix platform. Wix uses standard cookies and similar technologies needed to run and secure the site (for example, to keep the site loading properly and to protect against fraud). We do not use advertising or cross-site tracking cookies, and we do not run third-party analytics or advertising trackers on the site.

We do not knowingly collect information from anyone under 18.

3. Sensitive information

Some of what you may tell us may be “sensitive information” under the Privacy Act.

By sending us an enquiry or chat message that includes this kind of information, you consent to us collecting and using it for the purpose of assessing and responding to your enquiry. You do not have to share sensitive information with us. If you prefer not to include it in a form or email it to us, you can discuss it by phone and share documents via a Dropbox or Google Drive link or folder invitation instead.

We treat sensitive information with extra care and only use it for the purpose you gave it to us.

4. Why we collect it and how we use it

We collect and use personal information to:

• Respond to your enquiry and assess whether we can help

• Communicate with you about the information you send us and our work

• Reconstruct and analyse the financial records and other documents you provide to identify transactions, inconsistencies, unexplained movements and patterns that may warrant further investigation, then return the findings and supporting documentation to you

• Meet our legal, professional and record-keeping obligations

We will not use your personal information for marketing without your consent, and we will never sell your personal information to anyone.

5. Disclosure and website hosting

We provide information and findings only to you, our client. We do not share your personal information or our findings with professional advisers, solicitors, authorities or anyone else as part of our usual work. Any further sharing is your choice and is for you to carry out. We do not deal directly with your solicitor.

The only exceptions are where disclosure is required or permitted by law (for example, in response to a court order), or where disclosure is necessary to lessen or prevent a serious threat to someone’s life, health or safety.

Our website is hosted by Wix. Wix stores and processes information submitted through the site, including form and chat messages, on our behalf as the website hosting provider. This is part of the infrastructure for running our site, not a disclosure of our findings to a third-party recipient.

6. Overseas disclosure

Our website is hosted by Wix, which may store and process data on servers outside Australia. Dropbox and Google Drive may also store or process records and documents you share with us outside Australia. These services handle the information under their own privacy policies and security practices.

Apart from the website hosting and file-sharing services described above, we do not disclose personal information to overseas recipients, subject only to the limited legal and serious-safety exceptions in section 5.

7. How we store and protect it

Enquiries submitted through our website are stored in our Wix account and business email account (Gmail, provided by Google). Dropbox and Google Drive are third-party services that store and process documents shared through their links or folder invitations. We take reasonable steps to protect personal information from misuse, loss, unauthorised access or disclosure, including restricting access to people who need it to do their work.

We keep personal information only for as long as we need it for the purposes above, or as the law requires. When we no longer need it, we take reasonable steps to delete or de-identify it.

No method of transmission or storage is completely secure. If you have concerns about sending information online, contact us by phone, or share documents with us through a Dropbox or Google Drive link or folder invitation instead of email.

8. Access and correction

You can ask us for access to the personal information we hold about you, or ask us to correct it if it is wrong, out of date or incomplete. Email us at redflagfinancials@gmail.com. We will respond within a reasonable time. We may need to verify your identity before giving access.

9. Complaints

If you think we have breached your privacy, please contact us first so we can try to fix it:

• Email: redflagfinancials@gmail.com

If you are not satisfied with our response, you can complain to the Office of the Australian Information Commissioner (OAIC):

• Website: www.oaic.gov.au

• Phone: 1300 363 992

• Post: GPO Box 5288, Sydney NSW 2001

10. Changes to this policy
